Divorce Form Instructions

Steps to follow: Filing for Divorce; Court of Queen's Bench

  • File Statement of Claim for Divorce with the Clerk of the Court of Queen’s Bench ($210)
  • Have an adult (other than yourself) serve the Statement of Claim for Divorce upon the Respondent. Make sure you have given that adult a picture of the Respondent (it will be marked as Exhibit to their affidavit of service)
  • Have the adult that served the Respondent fill out the Affidavit of Service and swear that affidavit of service before a Commissioner for Oaths (all QB Court staff)
  • If there are children under the age of 16, the parties are required to take the parenting after separation seminar
  • Wait 20 days. On the 21st day (unless that is a Sat. or Sun) take the following completed documents to the Clerk of the Court:
    • Affidavit of Service (with photo of Respondent)
    • Noting in default
    • Request for Divorce
    • Affidavit of Applicant (with attached Certificate of Marriage (brown))
    • Divorce Judgment
    • 1 letter sized envelope addressed to yourself (with stamp)
    • 1 letter sized envelope addressed to the Respondent (with stamp)
